Trade and delivery conditions

These conditions apply to the website www.winetribe.dk, the subscription or trading services offered on the website, and the products delivered pursuant to subscriptions and customers. Please read these terms of trade. By using the Website or applying for a Winetribe subscription through the Website, you accept the Terms and agree to be bound by them. Winetribe recommends that you print a copy of these Terms.

We reserve the right to make changes or updates to these Terms of Service at any time.

2. Order and subscription

At Winetribe you can buy products with a subscription. Read more in the conditions below.

2.1. You can only shop at Winetribe if you are at least 18 years old. You should also be aware that the website only delivers products to addresses in Denmark (unfortunately this does not apply to addresses in Greenland and the Faroe Islands).

2.2. When we receive your order on our website, you will receive a receipt to the e-mail address you provided in connection with the purchase containing information about your order.

2.3. A subscription means that, every two months, you get products delivered to the address you have specified. Certain special subscriptions (e.g. certain gift services) may be limited to one delivery, so that the agreement only applies to this specific delivery and automatically terminates thereafter. The Winetribe product is composed of several (typically five) different wines in flasks of approx. 100 ml per wine delivered in a special package.

2.4. We reserve the right to refuse to do business with you without reason.

3. Prices

3.1. With the exception of obvious typographical errors, the prices and shipping costs stated at any time on the website apply. All prices on the Danish website are listed in DKK including Danish taxes, customs and VAT.

3.2. The price of a subscription usually consists of a periodic subscription fee (eg a monthly fee). The prices that apply to your subscription are highlighted in connection with your application for a Winetribe subscription.

3.3. Prices and shipping costs are subject to change at any time.

3.4 You are bound by the prices in force at the time you took out your Winetribe subscription, unless we notify you of price changes and you do not, within 20 days of the date on which the notification is sent, notify Winetribe, that you do not accept such changed terms (the Winetribe subscription will be terminated immediately).

4. Payment

4.0. When purchasing goods that have not been subscribed to, the amount for the goods will only be deducted when the goods are sent from our warehouse. At the same time, we will send you an e-mail containing tracking information.

4.1. Upon entering into your Winetribe subscription, you agree to pay the periodic subscription fee until the subscription is terminated.

4.2. The first periodical subscription fee is paid immediately in connection with your application for subscription, and subsequent periodical subscription fees are normally paid on the last working day of the month before. If your application for a Winetribe subscription is not accepted (cf. point 2.4), no fee will be paid. NOTE: If you register before the month's broadcast, you will first be drawn for the previous month's Winetribe products (if this one is not sold out) and then the current month's Winetribe. It will take approx. one week between payments.

4.3. Payment must be made by credit or debit card (Dankort, eDankort). You agree that we may charge periodic subscription fees from your credit or debit card without further authorization until you change your payment via your account on the website, or by sending an e-mail to hello@winetribe.dk (with the addition of the time we have reasonably spent changing the payment).

4.4. Payment can also be made with a gift card or voucher issued by Winetribe (subject to the conditions set out in the relevant voucher or gift card).

4.5. We reserve the right to carry out a credit check on you.

4.6. If you need to change (including delete or renew) your credit or debit card, you can make the changes for your payment via your account on the website, or by sending an e-mail to hello@winetribe.dk (with the addition of the time we reasonably need to change the payment).

4.7. Please note that offers and discounts cannot be combined with existing discounts, reduced items or price promotions.

5. Delivery time

5.0 We deliver throughout Denmark, and we use different courier solutions depending on the destination. We endeavor to dispatch the order within 48 hours, and in Denmark we have a typical delivery time of 2-3 working days. A more precise delivery time will be indicated in the notification you receive when the Winetribe product has been or will be sent to you.

5.1. After entering into a subscription, you will receive Winetribe products every two months. Depending on when in a calendar month you have taken out a Winetribe subscription, the first Winetribe products will be delivered during the same month or the next month.

5.2. If a Winetribe product is sold out, we reserve the right not to deliver the relevant Winetribe product in the current calendar month. For subscribers, no subscription fee will be paid for that month, and for others, payment will not be withdrawn or refunded.

6. Termination and automatic renewal

6.1. You and Winetribe may at any time and without reason terminate the subscription at the end of the subscription period applicable at any time.

7. Right of withdrawal

7.1. If you are a consumer, you can legally change your mind within 14 days ("withdrawal period") from the day you receive a Winetribe product. This cancellation period must always include at least seven working days.

7.2. You can only exercise your right of withdrawal if the Winetribe products are essentially unchanged. This does not apply if the Winetribe product has been damaged or altered due to an action that was necessary to examine the product or due to a circumstance beyond your control.

7.3. You exercise your right of withdrawal by contacting us before the expiry of the withdrawal period, after which we send a return label, and by returning the Winetribe product to us using the sent return label. You can contact us by sending an e-mail to hello@winetribe.dk

7.4. If you exercise your right of withdrawal, Winetribe will refund what you have paid for the Winetribe product in accordance with our returns policy (see clause 9 below).

7.5. Information about your statutory right of withdrawal is also set out in our notification that a Winetribe product has been or will be sent to you.

8. Complaints

8.1. From 15 February 2016, all consumers in the EU will also have a new common European complaint portal, which gives the opportunity to complain directly to companies in other EU countries. The purpose of the European complaints portal is to make it easier for both consumers and online stores to handle complaints across borders. You must of course also have this option. You can find a link to the complaints portal here http://ec.europa.eu/consumers/odr/. However, we hope that you will take any Dyst modings directly with us. It's faster for you, and we're ready by the phones and keys and would love to help.

9. Return policy

9.1. If you return a Winetribe product to us after you have exercised your right of withdrawal (see point 7 above), we will process the refund quickly, and no later than 14 days from the date we received the Winetribe product back. We will thus refund the price of the Winetribe product. We bear the costs of returning the Winetribe product to us (cf. point 7.3 above).

9.2. If you return a Winetribe Product to us for any other reason (for example, because you believe the Winetribe Product is defective), we will examine the returned Winetribe Product and notify you by email within a reasonable time regarding your refund . We usually make a refund as soon as possible and no later than 14 days from the date on which we received information that the purchase is to be cancelled. We will thus refund the price of the Winetribe product and any reasonable expenses you have incurred by returning the Winetribe product to us.

9.2.1. As a starting point, we will refund money to you using the same payment method that you used to complete the payment to us.

10. Liability

10.1. If you are a consumer, our responsibility for the delivered Winetribe products is governed by the chapter on Consumer Purchases in the Danish Sales Act (LBKG 2003-03-28 no. 237). In other cases, we are only liable for breaches of these terms, and only for a total amount corresponding to your annual subscription fee, unless there are cases of gross negligence or intentional conduct. These restrictions only apply if they are in accordance with applicable Danish law.

11. Force majeure

11.1. Winetribe is not responsible for any failure to perform or delay in performing any of our obligations under a subscription caused by events beyond our reasonable control (force majeure).

11.2. Force majeure includes any act, event, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:

11.2.1. Strikes, lockouts or other industrial action;

11.2.2. Civil unrest, insurrection, invasion, terrorist attack or threat of terrorist attack, war or threat or preparation for war;

11.2.3. Fire, explosion, storm, flood, earthquake, epidemic or other natural disaster;

11.2.4. Impossibility of using railways, shipping, aircraft, motor transport or any other form of public or private transport; and

1.2.5. Impossibility of using public or private telecommunications networks.

11.3. Our services under any subscription are deemed to be suspended for the duration of the force majeure event. Winetribe will use our reasonable efforts to bring the force majeure event to an end or to find a solution whereby our obligations under the subscription can be performed despite the force majeure event.

12. Third Party Sites

12.1. This website may contain links to websites operated by one of our partners, advertisers or affiliates or other third parties. Please note that we are not responsible for the content of such websites or the goods or services offered there.

13. Notices

13.1. Messages to us must be sent to hello@winetribe.dk. Notices to you will be sent to the email address you have provided on the website.

14. Intellectual Property

14.1. Winetribe or our licensors own all intellectual property rights to the website and all materials posted on the website. These rights and materials are protected by copyright and all rights in this connection are reserved.

14.2. You can print a copy or download extracts of pages on the website for personal use. You may not use any part of our copyrighted material for commercial purposes without first obtaining a license from us or our licensors.

14.3. By signing a subscription, you grant us an irrevocable right to quote from comments about Winetribe, Winetribe products and/or subscriptions that you have made on the website, blog or social media and to use quotes on our website, on social media and by other marketing.

15. Additions and changes

15.1. We may make additions or changes to these Terms from time to time. You will be bound by the terms in effect at the time you subscribed to Winetribe, unless we notify you of changes to these terms and you do not, within 60 days of the date on which the notice is sent, inform us that you do not accept such changed terms (if applicable, your subscription will immediately end).

16. Transfer of rights and duties

16.1. You may not assign your rights or obligations under the Subscription without our prior written consent. Winetribe may assign our rights or obligations under the subscription at any time during your subscription period.

17. Choice of law and disputes

17.1. These terms and your subscription must be interpreted and applied in accordance with Danish legislation. Disputes arising from these terms or your subscription must be settled by the Danish civil courts.

18. Gift card

18.1. The buyer of the gift card has a two-week right of return, during which the money can be refunded. The money can only be returned if the gift card has not been redeemed by the recipient.

18.2. The recipient of the gift card cannot have the value of the gift card paid out.

18.3. When the gift card is redeemed, the recipient has the option of choosing between receiving the current box as soon as possible or getting the first box at the next box distribution (3rd or 4th week of each month).

19. Labeling of the wine

19.1. In order to enable blind tasting, when you shop at Winetribe, you agree that some of the information found on the bottles is hidden with a label (including, but not limited to, country, exact alcohol percentage, importer, etc.), so that it is not directly visible on the bottles.
